These Terms of Use ("Terms") govern your use of all Landscape, LLC (“Landscape”, “us”, or “we”) apps and services, including iOS apps (the "Application") and web services (the “Service”). By accessing and using Landscape, you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not accept these Terms and the Privacy Policy, you are not authorized to use the Application and/or Service. We may modify these Terms and the Privacy Policy at any time and such modification will be effective upon posting to the Application.
We are committed to respecting your privacy and the confidentiality of your personal information. We will process your personal information, the traffic data and the content of your communication(s) in accordance with our Privacy Policy. Please read it carefully before starting using the Application and/or Service.
We reserve the right to refuse service to anyone, anywhere, anytime, for any reason. Such as, but not limited to: using the app for unintended purposes, using an unreasonable amount of resources, or abuse of the terms, as defined solely by Landscape at our discretion.
Parts of the Application are provided through the Apple App Store on a paid subscription basis ("Subscription"). The Application's Subscription rates are listed in the App and on the App Store. We reserve the right to modify its rates at any time and/or to offer special promotions. We can not issue refunds for Subscriptions; Apple reserves this ability for themselves only. Landscape not send invoices to its customers (since we do not bill you); Apple reserves this ability for themselves only. You have confidential access to your account balance information through the App Store. If you have a billing dispute, you must contact the App Store to seek a remedy.
You may discontinue the Subscription at any time by contacting the App Store. You will not be entitled to any refund of unused balances if you discontinue the Subscription. Additionally, you will remain responsible for payment of all charges for the Subscription rendered up through the date you discontinue the Subscription.
From time to time, we may provide you with links to third party websites or services that we do not own or control. Your use of the Service may also include the use of applications that are developed or owned by a third party. Your use of such third party applications, websites, and services is governed by that party’s own terms of service or privacy policies. We encourage you to read the terms and conditions and privacy policy of any third party application, website or service that you visit or use.
We put a lot of effort into creating the Application and Service including, the logo and all designs, text, graphics, pictures, information and other content (excluding your content). This property is owned by us or our licensors and it is protected by U.S. and international copyright laws. We grant you the right to use it. However, unless we expressly state otherwise, your rights do not include: (I) publicly performing or publicly displaying the Application or Service; (II) modifying or otherwise making any derivative uses of the Application or Service or any portion thereof; (III) using any data mining, robots or similar data gathering or extraction methods; (IV) downloading (other than page caching) of any portion of the Application or Service or any information contained therein; (V) reverse engineering or accessing the Application or Service in order to build a competitive product or service; or (VI) using the Application or Service other than for its intended purposes. If you do any of this stuff, we may terminate your use of the Application and Service.
IN NO EVENT SHALL LANDSCAPE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION; (III) ANY CONTENT OBTAINED FROM THE APPLICATION; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
THE APPLICATION IS INTENDED FOR ENTERTAINMENT PURPOSES ONLY. ACTIVITIES ASSOCIATED WITH THE APPLICATION CAN AT TIMES INVOLVE RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER DANGERS ASSOCIATED WITH SUCH ACTIVITIES. LANDSCAPE IS NOT RESPONSIBLE FOR ANY SUCH PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE APPLICATION. PARTICIPATION IN ACTIVITIES ASSOCIATED WITH THE APPLICATION AND/OR THE USE OF THE APPLICATION IS AT YOUR OWN RISK. LANDSCAPE MAKES NO GUARANTEES, REPRESENTATIONS OR WARRANTIES (EXPRESS OR IMPLIED) RESPECTING THE ACCURACY, COMPLETENESS OR SUITABILITY OF THE INFORMATION AND DATA. LANDSCAPE IS NOT RESPONSIBLE FOR THE MISUSE OR MISREPRESENTATION OF THE INFORMATION AND/OR DATA PROVIDED, AND ANY RELIANCE YOU PLACE ON SUCH INFORMATION AND/OR DATA IS AT YOUR OWN RISK.
LIMITATION OF LIABILITY: THE MAXIMUM LIABILITY OF LANDSCAPE SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE APPLICATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDSCAPE IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.
THESE TERMS AND CONDITIONS DO NOT ALTER OR DETRACT FROM APPLE’S LICENSED APPLICATION END USER LICENSE AGREEMENT.
Any claim relating to Landscape shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions
